In "Fatal Shore", a good book on australian convicts, a complementary explanation is proposed: british justice guaranteed the higher degree of protection to accused against arbitray (e.g. excluding torture), but inflicted an harsh treatment to convicted (including death penalty for minor thieves).

So perhaps Picton was breaking british justice standards, no matter the humanitarian aspect of the question?
