I think if you check you will find all major armies had some type of code of military law, perhaps not as developed as the British, but there had to be regulations of conduct, etc. if for no other reason than to ensure proper discipline and subordination.
As for Britain attacking Russia -- never would have happened. The British are not stupid, you know.
