While Dupont obviously has to bear final responsibility for the capitulation at Bailen whether he was responsible for the circumstances that made it necessary has been disputed. I can't see how he was responsible for the subsequent ill-treatment of his troops which he could not have expected.
It would have been correct to court-martial him but instead, after a long delay, he was put in front of a specially selected commission which knew what was expected of it.
