I don't know where you got the idea that military justice was under discussion.
If you are still thinking about Dupont (which is a rather large leap from the original discussion about corruption) then the whole point of the matter is that Dupont did not get military justice: Napoleon wanted to stick a treason charge on him so had to find a court that could try such a case.
